Court records reveal that Jamie Foxx is facing allegations of physical assault from a woman at a New York restaurant.
The complaint, filed in New York Supreme Court and obtained by PEOPLE, states that the incident occurred in August 2015 at Catch NYC. The woman, referred to as Jane Doe, reported seeing Foxx with Mark Birnbaum, a co-founder of Catch Hospitality Group, at the restaurant.According to the complaint, around 1:00 a.m., the woman and a friend approached Foxx for a photo. Allegedly, Foxx, identified by his real name Eric Marlon Bishop, made flattering comments about her appearance and led her to a secluded part of the rooftop.
Accused of assault
The woman claimed in the filing that Foxx touched her inappropriately, starting by placing his hands on her waist and moving them under her clothing to touch her chest. Despite her attempts to distance herself and the presence of a nearby security guard who reportedly walked away, Foxx allegedly continued by touching her private parts.
The woman mentioned that when her friend arrived and saw the situation, Foxx stopped and walked away.She detailed suffering physical and emotional injuries, requiring medical treatment and causing her significant distress. Seeking damages for her pain, economic loss, and punitive damages, the woman highlighted the lasting impact of the alleged assault.
One-year window to pursue legal action
The filing falls on the last day under New York’s Adult Survivors Act, allowing victims of physical assault, even from years prior, a one-year window to pursue legal action.
The text also mentioned other recent accusations within the industry, such as a lawsuit filed by Cassie Ventura against Sean “Diddy” Combs, which was subsequently settled amicably. Additionally, Harve Pierre, former president of Combs’ Bad Boy Records, faced accusations of physical harassment and assault from a former assistant during 2016 and 2017, as per the recent filing.
